Forsyth County Dear Ms. Randleman: TRACY DAVIS Director This letter is in response to proper reporting of consecutive exceedances of stormwater monitoring results for copper and zinc at the facility located at 1000 Deere -Hitachi Road in Kernersville and in regard to your "Request for Monitoring Relief'. The facility is currently covered under a NC General Stormwater Permit as required by the Federal Environmental Protection Agency. You have been conducting analytical monitoring as the permit requires. You and your staff followed Reporting Requirements of the General Permit and went into Tier II and Tier III Monitoring as required. Investigation and sampling of un-contaminated rainwater and from offsite stormwater as well as testing of soil samples has revealed levels of copper and zinc that exceed permit parameters. NCDEQ is granting regulatory relief in the form of a collapsed Tier 2 - Tier 3 response for the zinc and copper parameters only. _Upon receipt ofthis letter, Deere -Hitachi Construction ILfachinery Coro. 1000 Deere -Hitachi Road, may resume the permit snecifed semi-annual monitoring. This decision applies only to the copper and zinc benchmarks. The leaking infrastructure is part of the City of Winston-Salem sewer system. The City of Winston-Salem was notified immediately (-2:00 pm) and informed that the spillage was flowing down a drainage ditch into a nearby creek. We were informed by the City of Winston-Salem that it would be 2 — 3 hours before a technician would be on -site to assess the situation. We communicated to the city that we considered this to be an emergency and recommended that they get someone on site quickly to assess the situation and to make the repairs as soon as possible. (The City of Winston reference number for the sewer issue is 99585.) NCDEQ was notified of the incident at approximately 3:00 pm. In order to quickly eliminate flow to the local environment Deere -Hitachi placed absorbent booms near the entrance to the storm water receptor (3:00 pm) and constructed an earthen berm to contain the sewage (3:30 pm). Shamrock Environmental arrived on site shortly thereafter to pump sewage from the diked area and to clean out any other sewage that remained in the drainage ditch. The City of Winston-Salem was called several more times by Jeff Rowan, Brandon Hill and Debbie Randleman before they arrived at approximately 4:45pm. They removed the cover of a manhole and cleared the obstruction using pressurized water. Ultimately they discovered tree roots had grown into the pipe and caused the obstruction. The roots were removed. Clean-up was completed by 8:15 pm March 31, 2016. The city plans to run a camera through the sewer lines the week of April 4— 8, 2016 to investigate and determine to what extent the root system has grown in order to determine how to rectify the issue. VAN DER VAART Secretary TRACY DAVIS On January 26, 2016 Glen White of the North Carolina Department of Environmental Quality, Department of Energy, Minerals and Land Resources met with you at the subject facility located at 1000 Deere'Hitachi Road, Kernersville, NC to conduct an inspection for compliance with the facilities Industrial Stormwater Permit. Inspection consist of review of the Stormwater Pollution Prevention Plan, training and monitoring records and observation of the general condition of the site and all outfalls. Present and assisting with inspection were your engineers Brandon Hill, PE and Winfred Locus, The Facility Supervisor Bobby Bryant, and yourself, Environmental Coordinator. Everyone's cooperation and assistance with the inspection was greatly appreciated. Permit: This facility holds General Stormwater Permit NCG030240 to discharge stormwater from industrial activity associated with Metal Fabrication under the National Pollutant Discharge Elimination System (NPDES). The permit became effective November 1, 2012 and expires on October 31, 2017. A copy of the current permit is required to be maintained with the Stormwater Pollution Prevention Plan (SPPP) documents. A copy of the current permit was available for review at the time of inspection. Records/Reports: This facility was required to develop and maintain a Stormwater Pollution Prevention Plan (SPPP) in accordance with Part II, Section A of the permit. The SPPP is currently being updated to show new facilities and site amenities. It was available for review and appeared to be well prepared and updated annually. The SPPP and monitoring records for this facility were maintained in the computer system and engineers were working on updated at the time of inspection. The SPPP includes documentation for employee training per the permit. Inspection consist of an external inspection of the site and all outfalls. The site appears to be very clean and well maintained. They have recently expanded operations and have new manufacturing facilities. The type of industrial activity and possible pollutants did not change with expansion. Effluent Receiving Waters: Stormwater from this facility drains to receiving waters designated as UT to Belows Creek (Kernersville Lake), a class WSIV;CA water of the Roanoke River Basin via outfalls as identified on the SPPP. Drainage water as it left the property via ditches/streams appeared clear. Drainage that flows onto the property appeared to contain significant suspended solids and tannins. Self -Monitoring Program: The facility has representative outfall status at locations as described in a letter from NCDENR on October 10, 2014 and as shown on the SPPP siteplan. This facility has been in a Tier 2 monitoring response as the permit requires since 2011 due to consistent elevation of TSS, zinc and copper in sampling. Ms. Randleman has conducted monitoring monthly as required and has taken steps to improve the site and has tried to improve sampling results, but there has been little change. She believes contamination in the drainage way is coming from contaminated waters offsite before they enter the Deere -Hitachi property. In inspecting the site, the inspector believes this may be the fact. Ms. Randleman will test offsite drainage water at locations just before entering the property boundary and she will also test the rainwater itself. These test should help determine what contamination exist in the offsite water and in the rainwater prior to entering the sites drainage ways. She will forward a copy of results to Glen White at glen.white i ncdenr•. for this office to review. If outside factors can be determined to be the cause of exceeded results, NCDEQ may allow the facility to reduce monitoring or return to bi-annual sampling as required for Tier 1 sites. The facility was found to be compliant with its stormwater permit requirements. Please include a copy of this report in your SPPP records. Offsite stormwater contamination is a probable strong contributor to the elevated results. She will also test the rainwater itself to determine if contamination could be in the rainwater. If results show that contamination exist in those samples and exceeds the results at the tested outfalls, facility may be allowed to reduce Tiered Response effort. Your assistance and cooperation were greatly appreciated. An inspection checklist is attached for your records and the inspection findings are summarized below. This facility is located at 1000 Deere -Hitachi Road in Kernersville, Forsyth County, North Carolina. Stormwater related to industrial activity is discharged from the site to an unnamed tributary to Kerners Mill Creek, which is currently classified as Class WS-II1 waters, in the Yadkin Pee -Dee River Basin. Documentation & Monitoring Review This inspection was conducted to assess compliance with NPDES General Stormwater Permit NCG030000 and to evaluate the drainage to the facility's Stormwater Discharge Outfalils (SDOs). Tier III response has been triggered by consecutive exceedances of the copper benchmark at SDO 1 and zinc benchmarks at SDO 2. Please keep in mind that benchmark exceedances are not limit violations or violations of permit conditions; however you are obligated to follow the tiered response actions outlined in your permit. Deere -Hitachi Construction Machinery Corp. has been following the tiered response actions and is therefore in compliance with the permit. The facility's Stormwater Pollution Prevention Plan (SPPP) contains all of the required elements and is up to date and fully implemented. Both qualitative and analytical monitoring have been completed as required, including increased monitoring required by the tiered response. Tiered Response Requirements Currently, monthly monitoring is required in response to two consecutive exceedances of the benchmark values or range for any specific parameter at a specific SDO. Deere -Hitachi Construction Machinery Corp. has completed monthly monitoring for all applicable outfalls as well as taking extensive actions to identify and eliminate potential sources of pollution. The facility has used video equipment to assess stormwater pipes, replaced baffles in basins, and taken soil samples on site. Corrugated building materials could be a potential contributing factor to benchmark exceedances not related to industrial activity. Deere -Hitachi Construction Machinery Corp. continually takes measures to reduce the potential for stormwater contamination on site and has a very rigorous environmental program. At this time, the Division concurs that more frequent monitoring at this site would be ineffective. The Division relieves you of the additional monitoring frequencies required in the Tiered Response section of this permit for copper at SDO 1 and zinc at SDO 2. You must continue to monitor semi-annually as required by the permit, but you will not be required to institute monthly monitoring for any future exceedances of the copper parameter at SDO 1 or zinc parameter at SDO 2. Tiered response requirements still apply for all other parameters and at all other outfalls. You must notify this office in writing within five business days if you become aware of any significant source of copper or zinc at your facility that has the potential to be exposed to stormwater. The relief granted in this letter is contingent upon the current industrial practices and housekeeping actions at Deere -Hitachi Construction Machinery Corp. If industrial practices change and copper and/or zinc become a significant stormwater exposure risk at the specified outfalls, this office reserves the right to withdraw this decision and reinstate the permit - specified tiered response or other actions that may be warranted. We appreciate your efforts to comply with the stormwater permit and the proactive steps taken to identify and eliminate potential sources of pollution. No additional response to this letter is required, but please append this letter to your SPPP to document that your facility has been relieved of monthly monitoring requirements for the specified parameters. This approval is effective with the next sampling event. However, this approval is contingent on the following requirements: (1) All outfalls, regardless of representative status, must have a cleared path and the right of way to the outfall must be properly maintained. (2) The permit still requires that Qualitative Monitoring be performed at all Stormwater Discharge outfalls, regardless of representative status. In addition, please remember that any actions you initiate in response to benchmark exceedences as directed in the tiered response provisions of your permit must address all drainage areas, where appropriate. The site drains to an unnamed tributary to Kerners Mill Creek, which is currently classified as Class WS-III waters, in the Yadkin Pee -Dee River Basin. If changes in drainage areas, structures, processes, storage practices, or other activities occur that significantly alter the basis of this approval, representative outfall status may no longer be valid. The facility has acquired a 55 acre industrial park adjacent to the east side of the existing site. The entire industrial complex is now 109 acres. Construction is underway to add several manufacturing buildings, parking lots, and roads to the new site. There is one large building, utilized as a warehouse, which was in operation at the time of the property acquisition. Deere -Hitachi will continue to use this building as a warehouse. Please refer to the attached site map. Of the total 55 acres acquired, 49+1- acres has all stormwater runoff directed to a construction retention pond for sediment control, After the construction is completed, the retention pond will remain as a water quality BMP device. Deere - Hitachi intends to include the discharge point of the retention pond as a new SDO sampling point in compliance with the NPDES stormwater permit. It will be SDO #5 on the site map. All stormwater drainage from the existing property and the new site will discharge to Kerners Mill Creek. The remaining 6+/- acres (a flat grassy field) of the newly acquired land is isolated from the main tract to the south side by the elevated railroad tracks of Southern Railway. This parcel of land will remain undeveloped as a pervious grassy field. There are no point source discharges from this area. Deere -Hitachi is modifying its Stormwater Pollution Prevention Plan to incorporate the new property and manufacturing buildings. The facility is located at 1000 Deere -Hitachi Road, in Kernersville, Forsyth County, North Carolina, at approximate coordinates 36.136100°,-80.093100°. Stormwater related to industrial activity is discharged from the site via stormwater discharge outfalls (SDO) 001 through 004, to an unnamed tributary to Kerners Mill Creek, which is currently classified as a class WS-I11 (water supply) waters located in the Yadkin Pee Dee River Basin. Documentation & Monitoring Review The Stormwater Pollution Prevention Plan (SP3) is complete and is currently being completely implemented. Mr. Boone found no deficiencies in the SP3 document. The facility exceeded the Total Suspended Solids (TSS) benchmark at SDO 002 in February and October, 2011. It is therefore in tier two monitoring for TSS at SDO 002. The facility has taken measures to reduce TSS concentrations at 002 including the installation of rip rap and flow baffles in the swale leading to the discharge pipe. It is suspected that the pipe that leads to 002 may be crushed or corroded and that the flow of water to the outfall through the pipe is picking up significant suspended solids by the time it reaches the end of the pipe. The next step may be to dig up and replace the pipe in question. Also, the facility exceeded the TSS benchmark at SDO 003 in February, 2011, but there have been no further exceedences at this SDO.
