Good morning, Brian,
Fortron Industries in New Hanover County had a wastewater permit that included stormwater, and that wastewater
permit now requires the company to apply for a separate stormwater permit from DEMLR. We've had a request from
them to be excluded from applying for a stormwater industrial permit, based on no potential to discharge. Our general
rule of thumb is whether an industry has something on site that retains stormwater and does not discharge in response
to a 25-year, 24-hour storm (mirroring the most stringent of engineering design requirements for Non -Discharge
permitted systems). They are making a case for this for their Infiltration Basin 4 (see attached letter from them and two
attachments).
While they have presented a case for this one area of the site, we have noticed there could be other areas on site with
industrial activities that drain elsewhere, and may require a discharge permit. Several go to other infiltration basins,
which were permitted under a State Stormwater Permit (Linda Lewis sent us that — see attached). These basins appear
to have a 10-year, 24-hour design, which does not meet the threshold we use for NPDES stormwater. However, it's
unclear exactly where industrial activities and storage is on this site.
To make a final determination, a site visit will be important. We'd recommend that WiRO take someone along from the
State Stormwater Program too. Could the regional office let us know if their claim is appropriate, or if there are other
potential stormwater discharge outfalls at this site, so we can advise them on whether or not to submit an application
for a permit? I cannot remember the specific activities here (polyphenylene sulfide manufacture, maybe?), so I don't
know whether a general permit could apply — you'll have to verify that during a visit.

As explained in the attached documents, Fortron Industries is requesting an exclusion to the NPDES Industrial
Stormwater permitting requirements for Outfall 002. As stated in the letter, there has never been an observed or
documented discharge from the outfall since its construction in 1992.

2. Hydraflow 25-year 24-hour Routing Calculation
3. Site Layout from Stormwater Management Plan.
